These Terms of Sale apply to every order placed on gmofbyfernmallis.com (the “Site”). Please read them before you order. By placing an order you agree to these Terms of Sale, our Terms of Use and our Privacy Policy.
1. Who sells to you
Products on the Site are sold by Fern Mallis (“we”, “us”, “our”). Mailing address: [Business address — to be confirmed]. Email: orders@gmofbyfernmallis.com.
2. Who can order
You must be at least 18 years old, or have the consent of a parent or guardian, and able to enter into a binding contract. We currently ship to addresses in the United States only.
3. Products
We describe and photograph our products as accurately as we can. Colours depend on your screen, and photographs may be styled, so the item you receive may differ slightly in shade, print placement or finish. Many pieces are made to order after you buy them. Sizes, materials and care information are listed on each product page.
4. Prices, taxes and payment
- Prices are in US dollars and include no tax. Sales tax is added at checkout where it applies.
- Shipping charges are shown in your bag and at checkout before you pay.
- Payment is processed by Stripe, Inc. We never see or store your full card number. Stripe’s handling of your payment information is governed by Stripe’s Privacy Policy.
- If a price on the Site is wrong because of an error, we will tell you and give you the choice to continue at the correct price or cancel for a full refund.
5. Your order
After you pay you will receive an order confirmation by email. This confirms that we have received your order; it does not yet mean we have accepted it. Our contract with you is formed when we ship your order. We may decline or cancel an order — for example if a product is unavailable, an order appears fraudulent, or quantities exceed reasonable personal use. If we cancel, we will refund you in full.
To change or cancel an order, email us as soon as possible. Because pieces may be made to order, we cannot always change an order once production has started.
6. Shipping and delivery
Orders are normally prepared within 3–7 business days and then delivered within 3–7 business days. Shipping is $8 per order, and complimentary on orders over $150. If we cannot ship your order within the time we stated, we will tell you, give you a revised date, and let you cancel for a full refund. Title and risk of loss pass to you when the order is delivered to the carrier. If a parcel is lost or arrives damaged, contact us and we will work with the carrier to resolve it. 7. Returns and refunds
You may return unworn, unwashed items in their original condition within 30 days of delivery. Refunds go back to your original payment method. Full details are in our Shipping & Returns policy, which forms part of these Terms.
8. Damaged or defective items
If an item arrives damaged, defective or not as ordered, email us within 14 days of delivery with your order reference and a photo. We will replace it or refund you in full, including shipping.
9. Warranties
Except as stated in these Terms, and to the fullest extent permitted by law, products are provided without other warranties, express or implied. Nothing in these Terms limits any rights you have under consumer protection laws that cannot be waived.
10. Limitation of liability
To the fullest extent permitted by law, our total liability arising from any order is limited to the amount you paid for that order, and we are not liable for indirect, incidental or consequential losses. This does not limit liability that cannot be limited by law.
11. Trademarks
GODMOTHER OF FASHION™ is a trademark of Fern Mallis. Buying a product does not give you any right to use the mark, the Site’s content or any other intellectual property. See our Trademark notice.
12. Governing law and disputes
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in New York County, New York, except that either of us may bring a claim in small-claims court where it qualifies. Please contact us first — most problems can be solved quickly by email.
13. Changes
We may update these Terms from time to time. The version on the Site when you place your order applies to that order.
